DIANA ROSS has won a court injunction preventing traffic police in TUCSON, ARIZONA from releasing a videotape of her undergoing roadside drink-driving tests.

The diva won the injunction in Pima County court on Thursday (January 2) after media outlets including TV show 'Inside Edition' and the Arizona Daily Star newspaper asked for copies of the tape.

She was cited last week (December 30) after being accused of allegedly driving under the influence, driving with a blood-alcohol level above the legal limit, and extreme driving under the influence.

Through her attorney Greg Davis, Ross, who was not present at the hearing, claimed that her "right to privacy, confidentiality and a fair trial will be irreparably damaged" if the tape is released, according to a report in the Arizona Daily Star.

The case will return to court on January 14, when Judge John Kelly will determine how and why the tape was made.

Ross, 58, was stopped by police on December 30, shortly after midnight. Her attorney claims that the recording of the stop was made after a police officer, who was not involved in the initial stop, learned of her identity. The police counter that it is standard police procedure to film stops, and that the officer who first stopped her had no video equipment in his car, so had to receive assistance from another officer to record it.
