Former METALLICA bassist JASON NEWSTED is being sued by unsigned Dallas band ECHO DRAIN for copyright infringement over the name of his new act ECHOBRAIN.
An eight-count $1million suit filed last week in Los Angeles District Court says Newsted's choice of band name causes 'confusion' among music consumers. It also says he used the name to infringe on Echo Drain's rights and material, including pirating a song title for his band's eponymous debut album.
Billboard reports Echo Drain's lawyer Morris Getzels saying: "When you go out and buy websites that are not in your name but in the name of the competitor, it not only shows that you know who they are; it shows that you want to hurt them."
