A construction worker is suing a stage equipment company for injuries sustained during the assembly of a giant tongue that forms part of the set of Miley Cyrus' Bangerz tour.

According to TMZ, Charles Nicholas Sarris is suing ShowFx Inc. the equipment company that was hired to make the novelty tongue, after he fell and hurt himself during construction of the prop. The claimant reportedly says he was not properly warned over the dangers involved and is suing for unspecified damages.

During the show, the tongue appears from a giant image of Cyrus' face. The singer slides down the protuberance to enter the stage. Watch the tongue in action below.

The Bangerz tour is currently making its way around the USA, and arrives in the UK in May. The tour has already attracted plenty of controversy, coming under fire for its sexually suggestive dance routines, one of which sees Cyrus simulate oral sex on a lookalike of former US President Bill Clinton. She has also been accused of being racially insensitive in her use of black backing dancers and faced calls that she' exploiting little people for having a number among her backing dancers.

Answering her critics in a February interview, Cyrus said: "I don't give a shit. I'm not Disney." She clarified: "I'm not Disney, where they have, like, an Asian girl, a black girl and a white girl to be politically correct, and, like, everyone has bright-colored T-shirts. You know, it's like, I'm not making any kind of statement."
