Nickelback singer abandons drunk driving appeal

Nickelback singer Chad Kroeger has abandoned his appeal against a drink-driving conviction.

Kroeger, real name Chad Robert Turton, was charged with DUI in May 2008 in regards to an incident in Surrey, British Columbia in June 2006.

Police found the singer to have a blood alcohol content of nearly double the legal limit when they pulled his Lamborghini over, after he was seen driving at 160km per hour.

The case resulted in Kroeger being banned from driving for one year and fined $600.

The singer appealed against his conviction after claiming that the arresting officer had violated his rights by forcing the star to blow in his face after detecting the smell of alcohol on his breath.

However, since launching the appeal, a similar case has been abandoned by the British Columbia Appeal Court, rendering Kroeger's request obsolete, reports Canoe.ca.

Kroger's lawyer, Marvin Stern, explained that the Nickelback frontman had no choice but to drop his appeal.

"Just like anybody else his rights are protected by the charter and at the time of the trial we felt that his rights had been violated," said Stern.

"The state of the law has now changed and we respect the current state of the law and are bound by it and in law there's no ground of appeal left."
