Cisco have confirmed that they have filed a lawsuit against Apple over the use of the name iPhone.
As previously reported, the IT company own the iPhone name, using it for an internet phone they released in December 2006.
However on Tuesday (January 9) Apple launched their "iPhone", which combines an MP3 player with a mobile phone.
It was thought that the two companies were working on an agreement over the name's use - however, Cisco are now taking legal action.
In a statement, Cisco’s Mark Chandler said: "There is no doubt that Apple's new phone is very exciting, but they should not be using our trademark without our permission.”
Cisco hope to obtain an injunction to prevent Apple from infringing upon and copying their iPhone trademark.
Apple have yet to comment. Their "iPhone" is due for release in the US in June, with a UK roll out expected later in the year.
