No Doubt settle 'Band Hero' lawsuit

No Doubt have settled their lawsuit with video game creators Activision over the use of the group's likeness in Band Hero.

Court papers have shown the Grammy-winning band reached a settlement with the games giant on Monday, quashing an impending trial which was due to begin on October 15, according to reports.

Gwen Stefani and co had sued Activision over the issue of their game characters being able to perform songs by artists other than themselves. They claimed that by allowing this to happen Activision had failed to stick to the agreement about the band's inclusion between the two parties.

This was met with a counter-suit from Activision, who claimed it was the band who were in breach of contract. The company claimed No Doubt had failed in their due diligence by not promoting the release despite supposedly benefiting from appearing in it and had been aware their characters would be used in such way.

However, a judge ruled in May this year that No Doubt could argue fraud, violation of publicity rights and breach of contract at the trial. It is unclear what the two parties have agreed upon with the out of court settlement.
