CASE...UH POSTPONED...UH

[B]FALL[/B] man finally attends court only to have his case postponed until January...

The Fall's Mark E Smith flew to New York for a hearing at Manhattan Criminal Court yesterday to face misdemenour assault and harassment charges, only to have the hearing postponed yet again.

A warrant for Smith's arrest was issued on September 30 when he failed to attend court. The case was adjourned until January 6.

Smith was arrested in April after allegedly kicking, punching and choking Julie Nagle, his girlfriend and the Fall's keyboard player.

Smith spent a night in the cells and was released on $1,000 bail, on condition he underwent counselling on his return to the UK.
