The two parties have resolved Ginn's claims new band Flag benefitted from Black Flag's identity
Ginn set a lawsuit in motion last August after Black Flag’s members formed two separate reunion groups. Flag comprises of original vocalist Keith Morris, original bassist Chuck Dukowski, Bill Stevenson, who drummed with the band between 1983 and 1985, and The Descendents’ guitarist Stephen Egerton. Henry Rollins was also named in the lawsuit, despite not being involved in either band.
The suit centred around Ginn’s complaints that Flag were benefitting from the Black Flag’s already established identity and were in violation of copyright infringement with regards to their name and logo.
Last October, a judge dismissed Ginn’s initial complaints, reasoning the black bars from Black Flag’s logo no longer exclusively belong to the band. The two parties have now come to a settlement for an undisclosed figure. Ginn’s lawyer Evan Cohen told Billboard: “Flag gets to be Flag, and Black Flag as it is presently known continues to be Black Flag.”
