USA court throw out case on half time show

A lawsuit about Janet Jackson‘s nipple baring 2004 Super Bowl show has been thrown out by a USA federal appeals court.

The singer, who was performing with Justin Timberlake at halftime, had a “wardrobe malfunction” during a song and flashed her breast to a television audience of around 90 million people.

A $550,000 indecency fine was launched against CBS Corp after viewers saw Timberlake reach for Jackson‘s top and sing: “Gonna have you naked by the end of this song.”

According to Billboard.com though a panel of judges ruled that the fine was wrong to be issued saying the Federal Communications Commission had “acted arbitrarily and capriciously”.
